Sir,
In confirmation of my telegram to Your Excellency of today, I have the honour to inform Your Excellency that the Chinese prisoner Tong Suk (or Cheung Suk) has been despatched under police escort from Bangkok by the B.S."Chowtai" to undergo at Hongkong a sentence of 7 years imprisonment imposed upon him by His Britannic Majesty's Court for Siam for committing a rape.
In Your Excellency's letter No.1668/1909 of the 15th ultimo, it is stated that the Government of Hong-kong is prepared to receive the prisoner Tong Suk upon the condition that the expenses of his maintenance in the Victoria Gaol are refunded. In this connection I have the honour to enclose for Your Excellency's information an extract from a despatch dated February 8th, 1906, addressed by the Secretary of State for Foreign Affairs to His Majesty's Judge in Bangkok on the subject of the maintenance of prisoners sent to serve sentences in the country of their origin.
As stated in my letter of February 25th, the prisoner in question was registered in His Majesty's Consulate-General here, on the strength of a passport (copy enclosed) issued by the Government of Hongkong in October, 1895. Your Excellency will observe that the passport states that Tong (or Cheung) Suk was born in Hongkong.
In view of the instructions issued by the Foreign Office, and of the fact that Tong Suk would appear to be a native of the Colony of Hongkong, I have the honour to inform Your Excellency that this Legation has no authority to defray the cost of his maintenance while in gaol.
